Navigating the Future of AI Regulation: A Global Imperative.

The current state of AI regulation is still in its early stages, but there is growing momentum toward managing AI in order to mitigate potential risks and ensure that it is used for good.

AI regulation varies across nations, reflecting differing priorities and legal systems. For instance, some countries adopt proactive approaches, implementing complex frameworks to address AI's impact comprehensively. Others opt for more permissive regulations, emphasizing the need to foster innovation and avoid stifling technological progress. 

However, this regulatory divergence creates a fragmented landscape that hinders global cooperation and makes compliance increasingly challenging for multinational businesses.

The AI Act. 

The European Union (EU) has been at the forefront of AI regulation, with the European Commission proposing the first major, most comprehensive AI regulation in the world, the AI Act, in 2021. The AI Act would classify AI systems according to their risk level (unacceptable, high-risk, and unlisted/unregulated) and impose different requirements, such as transparency, fairness, and accountability, on different types of systems. For example, high-risk AI systems would need to undergo a risk assessment, be developed using high-quality data, and be subject to human oversight.

The act primarily targets unacceptable and high-risk AI technologies, which include AI systems that

  • Use social scoring to rank people or make decisions about them. These systems are considered unacceptable because they can be used to discriminate against citizens or to limit their opportunities. Unfortunately, these technologies exist: think of the government-run social scoring used in China. 
  • Use subliminal techniques to manipulate people's behavior. These AI technologies are deemed unacceptable because they can be used to influence people and make them act in ways that are not in their best interests.
  • Draw on people's vulnerabilities, such as their financial situation or mental health. These solutions are considered high-risk because they can be used to harm people or take advantage of them.
  • Implement real-time biometric identification in publicly accessible spaces. These systems are high-risk because they can be used to track citizens’ movements and activities without their consent.

AI Across the World. 

Other countries around the globe are increasingly considering AI regulation as AI solutions start dominating industries. 

The United States has not yet adopted a comprehensive AI regulatory framework, but there are a number of proposals under consideration. For example, the Algorithmic Accountability Act would require US companies to disclose how their algorithms make decisions that affect people's lives.

China has been active in AI regulation, with the State Council issuing a number of guidelines on the ethical use of AI. In early 2022, China published two laws relating to specific AI applications: the Provisions on the Management of Algorithmic Recommendations of Internet Information Services and the Provisions on the Management of Deep Synthesis of Internet Information Services.

In addition to these, a number of other nations are also beginning to work on AI regulation, including India, Japan, South Korea, and Australia. The specific requirements of these regulations will vary depending on the country's specific needs and priorities.
